Terms of Service

These Terms of Service (“Terms”) govern your access to and use of plastictox.fluid.app, the PlasticTox customer portal, PlasticTox test kits, sample workflows, laboratory analysis, digital results, reports, guidance, and related services (collectively, the “Services”). By placing an order, creating an account, submitting a sample, or using the Services, you agree to these Terms and the Privacy Policy, Return and Refund Policy, and Shipping Policy.
1. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a contract to purchase or use the Services. You agree to provide accurate, current information; protect your account credentials; promptly notify us of suspected unauthorized access; and accept responsibility for activity conducted through your account.
2. The PlasticTox Service
PlasticTox provides an at-home saliva-based service designed to detect and count candidate microplastic particles and provide a personal exposure baseline, category context, and educational reduction guidance through a laboratory-supported workflow.
The Services are for personal exposure awareness and education only. They are not medical care and are not intended to diagnose, treat, cure, prevent, or predict any disease or health condition. PlasticTox does not measure phthalates, BPA, PFAS, or every type or size of plastic-related material. The Services do not establish that a detected particle caused or will cause any symptom, condition, or disease.
3. No Medical Relationship or Emergency Service
PlasticTox does not provide medical advice, and use of the Services does not create a physician-patient, clinician-patient, or other healthcare-provider relationship with PlasticTox. Do not disregard professional medical advice or delay seeking care because of a PlasticTox result. The Services are not designed for emergencies. Contact emergency services or a qualified healthcare provider for urgent or medical concerns.
4. Sample Consent and Responsibilities
By registering or submitting a sample, you confirm that the sample is yours, was collected with your informed authorization, and was collected and packaged according to the instructions. You authorize PlasticTox and its laboratory, shipping, technology, and service providers to receive, identify, transport, handle, analyze, quality-check, report, retain, consume, or destroy the sample and related information as reasonably necessary to provide the Services, comply with law, and perform permitted quality activities described in the Privacy Policy.
You must not submit another person’s sample, submit a sample without lawful authorization, alter identifiers, tamper with materials, or use a kit for an unlawful purpose. PlasticTox may reject or discontinue processing a sample that is mislabeled, insufficient, contaminated, damaged, delayed, unsafe, unauthorized, or otherwise fails laboratory acceptance or quality requirements.
5. Result Limitations
Results depend on the sample collected, collection timing and technique, transit and storage conditions, available methods, laboratory quality controls, and scientific limitations. A saliva sample reflects the tested sample and time point and may not represent total exposure elsewhere in the body or exposure over an entire lifetime. Environmental contamination, particle size, material characteristics, and method limitations may affect results.
No laboratory or measurement process is error-free. PlasticTox does not guarantee that results will identify every particle, be identical on repeat testing, show improvement, or produce any particular health outcome. Retesting may help compare time points, but differences must be interpreted with these limitations in mind.
6. Orders, Pricing, and Payment
Prices, availability, discounts, and product descriptions may change before an order is accepted. You authorize the applicable payment provider to charge the amount shown at checkout, including applicable taxes. An order confirmation does not guarantee acceptance or fulfillment. We may cancel or limit an order for suspected fraud, pricing or inventory errors, misuse, legal restrictions, or other legitimate reasons and will provide any refund required.
PlasticTox products are currently offered as one-time purchases unless checkout expressly states otherwise. The Single Test, 2 Pack, and 3 Pack are separate products. Bundle savings are based on the then-current single-test price and may change.
7. Shipping, Returns, and Refunds
Shipping, delivery, sample return, cancellations, returns, replacements, and refunds are governed by the Shipping Policy and Return and Refund Policy, incorporated into these Terms. Delivery and laboratory timelines are estimates, not guarantees. You are responsible for providing a complete, accurate delivery address and following all collection and return instructions.
8. Acceptable Use
You may use the Services only for lawful, personal purposes consistent with these Terms. You may not interfere with or reverse engineer the Services; bypass security; scrape or access systems without authorization; impersonate another person; introduce malicious code; use results to discriminate unlawfully; resell a kit or result as a medical diagnosis; infringe intellectual-property or privacy rights; or submit fraudulent, unsafe, or unauthorized samples.
9. Intellectual Property
The Services, website content, software, designs, trademarks, reports, educational materials, and related intellectual property are owned by PlasticTox or its licensors and are protected by law. PlasticTox grants you a limited, personal, nonexclusive, nontransferable, revocable right to use your purchased Services and view or download your personal report. No other rights are granted.
You retain rights in information you provide. You grant PlasticTox and its providers the limited rights necessary to process that information and provide, secure, and improve the Services as described in the Privacy Policy.
10. Privacy
Our Privacy Policy explains how we handle personal information, samples, and consumer health data. By using the Services, you acknowledge those practices and agree to provide any consent separately requested and required by law. Acceptance of these Terms alone will not substitute for a separate affirmative consent where applicable law requires one.
11. Third-Party Services
The Services depend on third parties, including laboratories, Fluid commerce and portal services, payment processors, carriers, hosting providers, and other vendors. Third-party terms may apply to their services. PlasticTox is not responsible for a third party’s independent acts or services beyond the extent required by applicable law, but this provision does not eliminate responsibilities PlasticTox cannot lawfully disclaim.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PLASTICTOX DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PLASTICTOX DOES NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, A PARTICULAR RESULT, OR THAT THE SERVICES WILL MEET EVERY USER’S EXPECTATIONS.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Any non-waivable warranty or consumer right remains in effect.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLASTICTOX AND ITS OFFICERS, EMPLOYEES, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY ARISING FROM A PARTICULAR ORDER OR USE OF THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO PLASTICTOX FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. These limits do not apply to liability that cannot legally be limited, including where applicable for fraud, willful misconduct, or certain personal injury or statutory consumer rights.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold PlasticTox harmless from third-party claims arising from your unlawful use of the Services, submission of another person’s sample without authorization, violation of these Terms, or infringement of another person’s rights. This obligation does not apply to claims caused by PlasticTox’s own unlawful conduct.
15. Suspension and Termination
We may suspend or terminate access where reasonably necessary to address fraud, abuse, unsafe conduct, security risk, legal requirements, nonpayment, or a material violation of these Terms. Provisions that by their nature should survive will survive termination, including payment obligations, intellectual-property provisions, disclaimers, liability limits, and dispute-related provisions.
16. Changes to the Services or Terms
We may modify the Services and these Terms. Changes apply prospectively from the stated effective date unless law requires otherwise. Material changes will be communicated in a manner reasonably designed to provide notice. Continued use after the effective date constitutes acceptance where permitted by law; if consent is legally required, we will request it separately.
17. General Terms
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; PlasticTox may assign them as part of a merger, financing, reorganization, or sale, subject to applicable law. Electronic records and signatures may be used in connection with the Services.
These Terms do not waive any rights that cannot be waived under applicable law. Any dispute will be governed by applicable law and heard in a court with lawful jurisdiction unless the parties separately agree to another permitted process.
